Effective June 12, 2014, a new Washington state law allows an individual to transfer real property to one or more beneficiaries effective at the transferor's death by executing and recording a transfer on death (TOD) deed.

The Washington state legislature amended the estate tax law to specifically include certain marital trust property, including pre-2005 marital trusts, for purposes of the Washington estate tax; to provide a deduction for family-owned business interests; adjusting the $2 million deduction by inflation on an annual basis; and increasing the top four estate tax rates.

With the controversy between "Fiscal Cliff" and the federal estate tax exemption seemingly resolved, unsuspecting Washington residents may still get a costly surprise when it comes to their estate taxes.  Many Washington residents need special estate planning to avoid estate tax.

If you haven’t specifically provided for distribution of your assets (which would include real property, stocks and bonds, personal property, retirement and life insurance), the Washington State Legislature has a statutory will, called the “Intestate Statute” (found at RCW 11.04.015) that will determine how your assets are distributed. SO BEWARE!

Because our firm represents many closely held businesses, we have had quite a number of clients whose estates may benefit from paying estate taxes over a long period of time, rather than having to pay the taxes when the Federal Estate Tax return is due.

Estate tax and what the legislature is going to do with it this year has been a topic on CNN and Fox this last week.  We have no legislative insider information, so this is a snapshot of what estate tax looks like today and what it will look like next year if the federal legislature does nothing by the end of 2012.
